Adjustment of Status

This term generally refers to each and every process that immigrants with a temporary residence permit must go through to enter a state of permanent residence.

The Immigration and Nationality Act, or INA, is the immigration agent that manages and organizes this change of status, which provides two ways by which you can obtain permanent residence status in the United States: already mentioned Adjustment of Status, and the consular procedure.
This time we will focus on Adjustment of Status, since it is the most effective and satisfactory procedure in most cases.
What are the procedures for adjustment of Status?
The first step to obtain an Adjustment of Status would be to determine if you are qualified to obtain it, meeting one of the following conditions:
- If the procedures are registered in your name by a family member with permanent residence If the procedures are carried out in your name by an employer who will hire you for a job
- You can also apply if you have previously obtained refugee or asylum status.
- The next step would be to file the immigrant petition, because once you know which category you belong to, you have to file the petition depending on the need of each person.
Here you have to open a parenthesis, because according to the need and category to which the person belongs, you must fill out a different form. How is this? For categories related to kinship, Form I-130 must be completed.
For categories related to employment, you must fill out Form I-140 or Form I-526 depending on whether it is an immigration petition for a worker and whether it is an immigration petition for an employer, respectively.
For special cases, such as in the case of widowers or if there is no one who can carry out the procedure on their behalf, it is best to fill out the I-360 form.
Depending on the category to which it belongs, the corresponding forms must be completed, in addition to the I-485 form, the Permanent Residence Application, also known as Adjustment of Status.
After completing the I-485 form and that it is processed, you will receive a notice to attend the Application Support Center, here all the data collection steps will be carried out to create a green card.
After this you will be called for an interview on a stipulated date where all the original documents, including passports, must be presented, in addition to the I-94 form, although the interview does not apply to all applications.
Once these steps have been completed, the final decision of approval or disapproval must be awaited, which will be sent by mail. This whole process tends to cost more than $ 1,225 and the time may vary depending on the category to which it belongs.
This procedure can also be done through a spouse. This procedure is usually faster and more efficient, additional documents such as a marriage or divorce certificate should be presented, if any. This is one of the main ways in which an Adjustment of Status is obtained in the USA.
All these procedures must be performed with a temporary stay visa in the United States, these visas are the B1 Visa and the B2 Visa. The B1 Visa is designed for temporary business trips and the B2 Visa is designed for tourist activities and visiting friends or family. Having one of these temporary stay visas, you can choose a Permanent Residence through the Adjustment of Status and the previous procedures.
