What is the PERM Labor Certification?
It is the First step of a Federal Program that grants DIRECT permanent Residence to all Immigrants who are inside or outside the United States, through a JOB OFFER.

STEP-BY STEP PROCESS OF PERM LABOR CERTIFICATION
- The labor certification process requires the employer to pay whatever the prevailing wage rate for the type of job in question is, as determined by the US Department of Labor.
- The employer must post advertisements to test the existing United States job market for qualified American workers.
- Employers submitting an application should direct DOL to make good faith efforts to contact each job applicant who responded to the announcements.
- You are unlikely to disqualify a resume worker alone, and may need additional steps, such as an interview, to be taken.
- Furthermore, the reasons for disqualification must be legal as well as acceptable by DOL rules. For example, the Department of Labor does not accept the argument that a United States applicant was too qualified for the job if the job applicant did, in fact, have the minimum degree and experience necessary to do the job.
- The Department of Labor maintains a database of normal requirements for different types of jobs. If an employer’s requirements for a particular job are greater than what the Department of Labor considers normal, the employer must develop a strong case for business needs.
- Job applicants who do not respond to phone calls or emails from the employer should send themselves a letter by certified mail.
- The Department of Labor requires all employers to maintain evidence of their recruitment efforts for 5 years after the application is submitted.
- If the labor market test does not convert United States workers who are qualified to do the job, the employer can file the application with the Department of Labor.
- The Department of Labor must make a determination that the employer has complied with the process rules, and that there are no qualified United States workers disadvantaged in the process of hiring a foreign worker.
- If DOL makes that determination, the Alien Job Application will be certified. This application can be used to file a Foreign Worker Immigrant Petition with the US Citizenship and Immigration Service.
